The purpose of this course is to provide an in-depth review and discussion of Tax-Deferred Exchanges Under §1031 of the Internal Revenue Code. Tax deferred exchanges create investment opportunities of which more real property owners are wanting to avail themselves given the current real estate market in Florida. A thorough understanding of §1031 exchanges will help title agents, which have customers that wish to identify investment opportunities in order to defer capital gains tax while also diversifying their portfolios, to communicate to their clients the aspects of the 1031 exchange process in a knowledgeable fashion. The course will first discuss the legal and regulatory basis for a 1031 exchange and its basic benefits. The instructor will review terminology and other key aspects of a 1031 exchange as well as what qualifies as an exchange under the rules as set forth by the IRS Treasury Regulations. There will be an in-depth review of the mechanics of handling and insuring a transaction involving a 1031 exchange. The last major topic will be an examination of the possible pitfalls and risks associated with a 1031 exchange.
